Про удосконалення законодавства про управління майном дітей

Abstract

У тезах розглядаються теоретичні та практичні проблеми правового регулювання управління майном дітей. Проаналізовано наукові підходи до розуміння поняття управління майном дитини, визначено його зміст та значення для належної реалізації майнових прав малолітніх і неповнолітніх осіб. Запропоновано авторське визначення управління майном дітей як юридично закріпленої діяльності батьків, опікунів і піклувальників, спрямованої на забезпечення належної реалізації майнових прав дитини. Обґрунтовано необхідність законодавчого врегулювання відповідних відносин шляхом прийняття спеціального Закону України «Про управління майном дитини», визначено його мету, принципи та запропоновано структуру. Зосереджується увагу на розробленій автором концепції спеціального законодавчого регулювання питань управління майном дитини, яка спрямована на вдосконалення механізмів захисту права дитини на майно.

The conference paper examines the theoretical and practical issues of the legal regulation of the management of children's property. It analyzes scholarly approaches to the concept of the management of a child's property, defines its content and significance for the proper exercise of the property rights of minor children and juveniles. The author proposes an original definition of the management of children's property as a legally regulated activity of parents, guardians, and custodians aimed at ensuring the proper exercise of a child's property rights. The paper substantiates the need for legislative regulation of these legal relations through the adoption of a special Law of Ukraine "On the Management of a Child's Property," identifies its purpose and guiding principles, and proposes its conceptual structure. Attention is devoted to the author's concept of a special legislative framework governing the management of a child's property, which is intended to improve the mechanisms for protecting a child's property rights.
