Правове регулювання майнових прав та обов’язків неповнолітніх

Abstract

У статті досліджено теоретичні та історико-правові засади регулювання майнових прав та обов’язків неповнолітніх як самостійних суб’єктів цивільних правовідносин. Проаналізовано особливості правового статусу неповнолітніх, обґрунтовано необхідність розмежування майнових прав дітей та їх законних представників, а також звертається увагу на відсутність комплексного правового регулювання цих відносин у чинному законодавстві України. Значну увагу приділено еволюції правового становища дітей у сімейних та майнових відносинах від найдавніших форм суспільної організації до сучасних підходів, заснованих на принципах рівноправності та поваги до прав дитини. Розглянуто вплив міжнародних стандартів, насамперед Конвенції ООН про права дитини, на формування національного законодавства у сфері захисту майнових інтересів неповнолітніх. Обґрунтовано необхідність закріплення у цивільному законодавстві України окремого комплексного правового інституту майнових прав та обов’язків неповнолітніх, який би визначав зміст відповідних правовідносин, механізми їх реалізації та гарантії захисту майнових прав дітей.

The article examines the theoretical and historical foundations of the legal regulation of the property rights and obligations of minors as independent subjects of civil legal relations. It analyzes the specific features of the legal status of minors, substantiates the necessity of distinguishing between the property rights of children and those of their legal representatives, and emphasizes the absence of comprehensive legal regulation of these relations in the current legislation of Ukraine. Considerable attention is paid to the evolution of the legal status of children in family and property relations, from the earliest forms of social organization to modern approaches based on the principles of equality and respect for children's rights. The article also examines the influence of international legal standards, in particular the United Nations Convention on the Rights of the Child, on the development of Ukrainian legislation concerning the protection of the property interests of minors. The study substantiates the necessity of establishing, within the civil legislation of Ukraine, a separate comprehensive legal institution governing the property rights and obligations of minors. Such an institution should define the content of the relevant legal relations, the mechanisms for exercising these rights and obligations, and the legal guarantees for the protection of children's property rights.
