Незалежна фахова експертиза як інструмент превентивного забезпечення законності договірних відносин

Abstract

У тезах розглядається незалежна фахова експертиза як інструмент превентивного забезпечення законності договірних відносин та належного правозастосування у сфері господарської діяльності. Обґрунтовано, що проведення експертної оцінки відповідності на ранніх стадіях виконання договорів сприяє своєчасному виявленню правових ризиків, запобіганню помилковому тлумаченню змісту господарських операцій і мінімізації можливих фінансових втрат. На прикладі договірних відносин у сфері оборонних закупівель проаналізовано правову природу господарської операції та встановлено критерії розмежування постачання товару, виконання робіт і операцій з давальницькою сировиною. Доведено, що незалежна фахова експертиза забезпечує об’єктивне тлумачення змісту правовідносин, сприяє правильному застосуванню норм цивільного та податкового законодавства, а також формує практику правового моніторингу договірних відносин на превентивному етапі. Зроблено висновок про перспективність використання оцінки відповідності (незалежної фахової експертизи) як інтегрованого елементу сучасної правової системи в умовах цифрової трансформації та європейської інтеграції.The theses examine independent professional expertise as an instrument for the preventive assurance of the legality of contractual relations and proper law enforcement in the field of economic activity. It is substantiated that conducting a conformity assessment at the early stages of contract performance contributes to the timely identification of legal risks, prevents the erroneous interpretation of the substance of business transactions, and minimises potential financial losses. Using contractual relations in the field of defence procurement as a case study, the legal nature of business transactions is analysed, and the criteria for distinguishing between the supply of goods, the performance of works, and toll manufacturing operations are identified. It is demonstrated that independent professional expertise ensures an objective interpretation of the substance of legal relations, promotes the correct application of civil and tax legislation, and establishes a practice of preventive legal monitoring of contractual relations. It is concluded that conformity assessment (independent professional expertise) has significant potential to serve as an integrated element of the modern legal system in the context of digital transformation and European integration.
