Питання правового визначення майнових прав та обов’язків неповнолітніх

Abstract

У тезах зосереджується увага на проблемах правового визначення майнових прав та обов’язків неповнолітніх в умовах реформування цивільного законодавства України та приведення його у відповідність до міжнародних стандартів захисту прав дитини. Аналізуються підходи вітчизняного та зарубіжного законодавства до регулювання майнових відносин між батьками та дітьми, звертається увагу на недоліки традиційного розуміння майнових прав неповнолітніх виключно через право на утримання та право на майно. Обґрунтовується необхідність виокремлення майнових прав та обов’язків неповнолітніх як самостійного правового інституту, що охоплює право на майно, право на одержання утримання від батьків, інших осіб та держави, а також обов’язки щодо утримання належного майна та відшкодування заподіяної шкоди. Наголошується на важливості закріплення відповідних положень у Цивільному кодексі України з урахуванням принципів Конвенції ООН про права дитини та сучасних підходів до визнання неповнолітнього самостійним суб’єктом цивільних правовідносин.

The conference paper focuses on the issues of the legal definition of the property rights and obligations of juveniles in the context of the reform of the civil legislation of Ukraine and its harmonization with international standards for the protection of children's rights. It analyzes the approaches adopted in Ukrainian and foreign legislation to the regulation of property relations between parents and children and highlights the shortcomings of the traditional understanding of the property rights of juveniles as being limited solely to the right to maintenance and the right to property. The study substantiates the need to recognize the property rights and obligations of juveniles as an independent legal institution encompassing the right to property, the right to receive maintenance from parents, other persons, and the State, as well as the obligations relating to the maintenance of property belonging to the juvenile and compensation for damage caused. The paper emphasizes the importance of incorporating the relevant provisions into the Civil Code of Ukraine in accordance with the principles of the United Nations Convention on the Rights of the Child and modern approaches recognizing juveniles as independent subjects of civil legal relations.
