Цивільно-правова відповідальність за шкоду, завдану неповнолітніми

Abstract

У статті досліджено особливості цивільно-правової відповідальності за шкоду, завдану неповнолітніми особами, та проблеми визначення кола суб’єктів, які повинні нести обов’язок із її відшкодування. Проаналізоване чинне законодавство України щодо відповідальності малолітніх і неповнолітніх осіб, а також відповідальності батьків, усиновлювачів, піклувальників, опікунів і відповідних установ за наслідки неправомірної поведінки дітей. Особливу увагу приділено співвідношенню особистої відповідальності неповнолітнього та відповідальності його законних представників, проблемі субсидіарної і солідарної відповідальності, а також умовам припинення обов’язку батьків щодо відшкодування шкоди. На підставі аналізу проєкту нового Цивільного кодексу України, наукових підходів та практичних аспектів застосування норм про деліктну відповідальність обґрунтовано необхідність удосконалення правового регулювання з урахуванням рівня розумової та моральної зрілості неповнолітнього. Запропоновано розширити роль органів опіки та піклування у вирішенні питань визнання неповнолітніх повністю дієздатними та визначенні меж їх самостійної майнової відповідальності, що сприятиме більш ефективному захисту прав як потерпілих осіб, так і самих неповнолітніх.

The article examines the specific features of civil liability for damage caused by minors and the issues of determining the range of persons who should bear the obligation to compensate for such damage. It analyzes the current legislation of Ukraine concerning the liability of minor children and juveniles, as well as the liability of parents, adoptive parents, custodians, guardians, and relevant institutions for the consequences of children’s unlawful conduct. Particular attention is paid to the correlation between the personal liability of a juvenile and the liability of the juvenile’s legal representatives, the issues of subsidiary and joint and several liability, and the conditions under which parents’ obligation to compensate for damage may be terminated. Based on an analysis of the draft new Civil Code of Ukraine, scholarly approaches, and practical aspects of applying the rules on tort liability, the article substantiates the need to improve legal regulation with due regard to the level of a juvenile’s intellectual and moral maturity. It is proposed to expand the role of guardianship and custodianship authorities in deciding on the recognition of juveniles as fully capable and in determining the limits of their independent property liability, which would contribute to more effective protection of the rights of both injured persons and juveniles themselves.
