Abstract

У тезах розглянуто актуальні питання охорони та захисту майнових прав і обов’язків неповнолітніх в умовах трансформації соціально-економічних відносин в Україні. Аналізуються особливості правового становища неповнолітніх як носіїв майнових прав та обов’язків, звертається увага на зростання їх участі у майновому обороті, володінні нерухомістю, корпоративними правами, грошовими коштами та іншими об’єктами цивільних прав. Висвітлюються проблеми недостатньої ефективності чинних механізмів захисту майнових інтересів неповнолітніх, зокрема у сфері розпорядження належним їм майном та забезпечення права на утримання. Обґрунтовується необхідність удосконалення цивільного законодавства шляхом нормативного закріплення системи майнових прав та обов’язків неповнолітніх, розширення правових гарантій їх реалізації та прийняття спеціального закону про управління майном неповнолітніх.

The conference paper examines current issues concerning the safeguarding and protection of the property rights and obligations of juveniles in the context of the transformation of socio-economic relations in Ukraine. It analyzes the legal status of juveniles as holders of property rights and obligations, highlighting their increasing participation in property transactions, ownership of real estate, corporate rights, monetary assets, and other objects of civil rights. The paper addresses the insufficient effectiveness of the existing mechanisms for protecting the property interests of juveniles, particularly in relation to the disposal of property belonging to them and the enforcement of their right to maintenance. It substantiates the need to improve the civil legislation of Ukraine through the statutory establishment of a comprehensive system of the property rights and obligations of juveniles, the expansion of legal guarantees for their exercise, and the adoption of a special law on the management of juveniles' property.
