Впровадження в Україні Інституту страхування військових ризиків

Abstract

У тезах розглядаються правові та організаційні аспекти впровадження в Україні інституту страхування військових ризиків в умовах збройної агресії Російської Федерації проти України. Досліджується значення міжнародно-правових механізмів захисту майнових інтересів осіб та суб’єктів господарювання, які зазнають збитків унаслідок воєнних дій. Розкриваються особливості імплементації міжнародних норм у національну правову систему та роль державних і міжнародних інституцій у формуванні механізму страхування військових ризиків. Проаналізовано сутність поняття ризику та специфіку страхування від наслідків війни, зокрема вторгнення, повстання, заворушень, терористичних актів та інших воєнних загроз. Висвітлено проблеми оцінювання таких ризиків страховими компаніями, складності визначення страхових премій та забезпечення фінансової стійкості страхових механізмів. Зроблено висновок про необхідність подальшого розвитку нормативних та інституційних засад страхування військових ризиків як важливого інструменту відшкодування збитків і захисту прав осіб в умовах збройних конфліктів.

The proceedings examine the legal and organizational aspects of implementing war risk insurance in Ukraine under the conditions of the armed aggression of the Russian Federation against Ukraine. The study explores the significance of international legal mechanisms for protecting the property interests of individuals and business entities that suffer losses as a result of hostilities. The article addresses the specific features of the implementation of international legal norms into the national legal system and the role of state and international institutions in forming a war risk insurance framework. The nature of risk and the specifics of insurance against the consequences of war, including invasion, rebellion, riots, terrorist acts, and other war-related threats, are analyzed. The study highlights challenges in risk assessment by insurance companies, difficulties in determining insurance premiums, and ensuring the financial sustainability of insurance mechanisms. It is concluded that further development of the regulatory and institutional framework for war risk insurance is necessary as an important instrument for compensation of losses and protection of rights in the context of armed conflicts.
