The methodology for conducting a conformity assessment regarding the absence of competition for technical reasons, which must be documented by the procuring entity in case of participation of a resident participant in the procurement

Abstract

У тезах обґрунтовується методика проведення оцінки відповідності щодо відсутності конкуренції з технічних причин як підстави здійснення закупівлі без застосування конкурентних процедур за участю учасника-резидента України. На підставі аналізу законодавства у сфері публічних та оборонних закупівель визначено основні етапи експертного дослідження, які включають встановлення відповідності предмета закупівлі можливостям учасника щодо поставки товарів, виконання робіт або надання послуг, перевірку його повноважень, дослідження документів, що підтверджують унікальність предмета закупівлі, а також оцінку відповідності учасника встановленим кваліфікаційним критеріям. Особливу увагу приділено доказуванню унікальності товарів, робіт і послуг як ключової ознаки відсутності конкуренції з технічних причин. Обґрунтовано доцільність проведення у таких випадках комплексної наукової експертизи за участю фахівців у галузях юридичних та технічних наук, що забезпечує всебічне дослідження предмета закупівлі та підвищує об'єктивність отриманих результатів. Зроблено висновок, що належне підтвердження відсутності конкуренції з технічних причин повинно здійснюватися експертною установою, яка має відповідні статутні повноваження, підтверджену кваліфікацію та компетентність експертів, функціонує відповідно до вимог міжнародних стандартів ISO 9001, ISO 37001, ISO/IEC 27001 та EN ISO/IEC 17020, а також забезпечує покриття ризиків професійної відповідальності. Запропонована методика може бути використана як практичний інструмент для підготовки експертних висновків щодо обґрунтування закупівель за відсутності конкуренції з технічних причин.

The theses substantiate a methodology for conducting a conformity assessment of the absence of competition for technical reasons as a legal ground for conducting procurement without the application of competitive procedures involving a resident tenderer of Ukraine. Based on an analysis of the legislation governing public and defence procurement, the principal stages of expert examination are identified. These include establishing the conformity of the procurement subject matter with the tenderer's capability to supply goods, perform works, or provide services; verifying the tenderer's authority; examining documents confirming the uniqueness of the procurement subject matter; and assessing the tenderer's compliance with the established qualification criteria. Attention is paid to proving the uniqueness of goods, works, and services as the key characteristic of the absence of competition for technical reasons. The expediency of conducting a comprehensive scientific expertise involving experts in the fields of legal and technical sciences is substantiated, ensuring a comprehensive examination of the procurement subject matter and enhancing the objectivity of the results obtained. It is concluded that proper confirmation of the absence of competition for technical reasons should be carried out by an expert institution possessing the appropriate statutory authority, confirmed professional qualifications and professional competence of its experts, operating in accordance with the requirements of ISO 9001, ISO 37001, ISO/IEC 27001, and EN ISO/IEC 17020, and ensuring the coverage of professional liability risks. The proposed methodology may serve as a practical tool for preparing expert opinions substantiating procurement conducted in the absence of competition for technical reasons.
