Проблеми правового регулювання управління майном дитини

Abstract

У тезах розглядаються актуальні проблеми правового регулювання управління майном дитини в Україні в умовах відсутності комплексного законодавчого врегулювання відповідних правовідносин. Обґрунтовується необхідність прийняття спеціального закону про управління майном дитини, який має забезпечити належний рівень захисту майнових прав та інтересів дітей. Автором запропоновано концептуальні положення майбутнього законодавчого акта, зокрема щодо визначення порядку управління майном дитини, підстав передачі функцій управління довірчому представнику, прав та обов’язків законних і довірчих представників, умов виплати винагороди за управління майном, а також механізмів державного контролю у цій сфері. Особливу увагу приділено ролі органів опіки та піклування та спеціалізованої служби з охорони прав дитини як суб’єктів контролю за дотриманням майнових прав дітей. Розроблено пропозиції щодо державної реєстрації майнових прав дітей, порядку звітування осіб, які здійснюють управління майном дитини, а також процедури отримання дозволів на вчинення правочинів з майном малолітніх осіб. Зроблено висновок про необхідність формування цілісного механізму управління майном дітей, спрямованого на забезпечення ефективного захисту їхніх майнових прав та законних інтересів.

The conference paper examines current issues in the legal regulation of the management of a child's property in Ukraine in the absence of comprehensive legislative regulation of the relevant legal relations. The author substantiates the need for the adoption of a special law on the management of a child's property that would ensure an adequate level of protection of children's property rights and legitimate interests. The paper proposes the conceptual framework for the future legislative act, including provisions governing the procedure for the management of a child's property, the legal grounds for transferring management functions to a trustee, the rights and obligations of legal representatives and trustees, the conditions for remuneration for property management, and the mechanisms of state supervision in this field. Attention is devoted to the role of guardianship and custodianship authorities and a specialized children's rights protection service as supervisory bodies responsible for ensuring compliance with children's property rights. The author also develops proposals concerning the state registration of children's property rights, reporting requirements for persons managing a child's property, and the procedure for obtaining authorization to conclude legal transactions involving the property of minor children. The paper concludes that it is necessary to establish a comprehensive system for the management of children's property aimed at ensuring the effective protection of their property rights and legitimate interests.
