Захист права власності неповнолітнього на нерухоме майно

Abstract

У статті досліджено проблеми захисту права власності неповнолітніх на нерухоме майно в умовах приватизації житлового фонду та здійснення цивільно-правових правочинів щодо житла. Аналізуються основні причини втрати неповнолітніми права власності на нерухомість, зокрема зміну місця проживання сім'ї та відчуження житла у зв'язку зі складним матеріальним становищем батьків. Особливу увагу приділено діяльності органів опіки та піклування та оцінці ефективності чинних механізмів контролю за дотриманням майнових прав дітей під час укладення правочинів з нерухомістю. У роботі вперше обґрунтовано необхідність застосування при наданні органом опіки та піклування дозволу на відчуження нерухомого майна дитини або належної їй частки житла умови щодо обов'язкового придбання законними представниками на ім'я дитини житла або частки житла за новим місцем проживання розміром не менше того, яке належало дитині до відчуження. Запропонований підхід був апробований у практичній діяльності Київської районної у місті Донецьку ради як ефективний механізм забезпечення житлових і майнових прав дітей. Водночас, обґрунтовано доцільність удосконалення процедур надання дозволів на відчуження нерухомого майна дітей та розглянуто перспективи використання інституту довірчого управління майном як додаткового механізму збереження нерухомого майна неповнолітніх і забезпечення їх майнових інтересів.

The article examines the issues of protecting the property rights of minors to real estate in the context of housing privatization and civil law transactions involving residential property. It analyzes the main factors leading to the loss of minors’ ownership rights to real estate, including changes in the family’s place of residence and the disposal of residential property due to the difficult financial circumstances of parents. Particular attention is paid to the activities of guardianship and custodianship authorities and to the assessment of the effectiveness of existing mechanisms for protecting children's property rights during transactions involving real estate. For the first time, the study substantiates the necessity of requiring, as a condition for granting permission by a guardianship and custodianship authority for the disposal of a child’s real estate or the child’s share in residential property, that the child’s legal representatives purchase, in the child’s name, a dwelling or a share therein at the new place of residence with an area not smaller than that owned by the child prior to the disposal. The proposed approach was implemented in the practical activities of the Kyiv District Council of Donetsk as an effective mechanism for safeguarding the housing and property rights of children. The article also substantiates the need to improve the procedures for granting permission to dispose of minors’ real estate and considers the prospects of using the institution of trust property management as an additional mechanism for preserving minors’ real estate and protecting their property interests.
