Здійснення неповнолітніми своїх майнових прав та обов’язків

Abstract

У статті досліджено правові засади здійснення неповнолітніми своїх майнових прав та обов’язків як складової їх цивільної правосуб’єктності. Автор аналізує обсяг цивільної дієздатності неповнолітніх відповідно до чинного законодавства України, особливості самостійного вчинення ними правочинів, розпорядження заробітком, стипендією, доходами від творчої діяльності, банківськими вкладами та іншими об’єктами майнових прав. Значну увагу приділено проблемі визначення вікових меж майнової самостійності неповнолітніх, ролі батьків, піклувальників та органів опіки і піклування у здійсненні контролю за реалізацією майнових прав дітей. На підставі порівняльно-правового аналізу законодавства Німеччини, Чехословаччини, Російської Федерації та міжнародних стандартів захисту прав дитини обґрунтовано необхідність удосконалення національного законодавства. Запропоновано визначати обсяг можливостей неповнолітнього щодо самостійного здійснення майнових прав не лише за формальним віковим критерієм, а й з урахуванням рівня його розумової та моральної зрілості, що сприятиме більш повній реалізації принципу рівноправності дітей як суб’єктів цивільних правовідносин.

The article examines the legal framework governing the exercise by minors of their property rights and obligations as an integral component of their civil legal personality. The author analyzes the scope of minors' civil capacity under the current legislation of Ukraine, including the specific features of their independent conclusion of legal transactions, disposal of earnings, scholarships, income derived from creative activities, bank deposits, and other objects of property rights. Attention is paid to determining the age limits of minors' property autonomy and to the role of parents, custodians, and guardianship and custodianship authorities in supervising the exercise of children's property rights. Based on a comparative legal analysis of the legislation of Germany, Czechoslovakia, the Russian Federation, and international standards for the protection of children's rights, the article substantiates the need to improve Ukrainian legislation in this area. It is proposed that the scope of a minor's ability to exercise property rights independently should be determined not only by the formal age criterion but also by taking into account the level of the child's intellectual and moral maturity. Such an approach would contribute to a more comprehensive implementation of the principle of equality of children as subjects of civil legal relations.
