Управління майном неповнолітнього: деякі пропозиції

Abstract

У статті досліджено правові засади управління майном неповнолітніх та особливості здійснення законними представниками повноважень щодо володіння, користування і розпорядження майном дітей. Проаналізовано історичний досвід правового регулювання управління майном неповнолітніх у римському праві, законодавстві Російської імперії та радянському сімейному законодавстві, а також надано оцінку стану нормативного врегулювання відповідних відносин в Україні. Особливу увагу приділено проблемі недостатньої правової регламентації порядку управління майном неповнолітніх, ризикам порушення їх майнових прав з боку законних представників та необхідності встановлення спеціальних обмежень щодо відчуження майна дітей. Обґрунтовано доцільність законодавчого визначення єдиного порядку управління майном неповнолітніх, спрямованого на збереження, примноження та належний захист їх майнових прав та інтересів до досягнення повноліття.

The article examines the legal framework governing the management of minors' property and the specific features of the exercise by legal representatives of the powers of possession, use, and disposal of children's property. It analyzes the historical development of the legal regulation of minors' property management in Roman law, the legislation of the Russian Empire, and Soviet family law, and evaluates the state of legal regulation of the relevant legal relations in Ukraine. Particular attention is paid to the problem of insufficient legal regulation of the procedure for managing minors' property, the risks of violations of their property rights by legal representatives, and the need to establish special legal restrictions on the disposal of children's property. The article substantiates the necessity of introducing a unified statutory procedure for the management of minors' property aimed at preserving, increasing, and ensuring effective protection of their property rights and legitimate interests until they reach the age of majority.
