Defining the Essence of Scientific-Legal Expertise: On the Expediency of Legal Regulation of Scientific-Legal Expertise in Ukraine

Abstract

The theses substantiate the expediency of using the universal term specialized legal knowledge to denote the knowledge of experts in various fields of legal sciences. Based on the classification of legal sciences and the specific features of the training of academic personnel, it is demonstrated that an expert is a knowledgeable specialist in the relevant field of legal science and academic specialty, and that such knowledge is specialised in nature. The author proposes a definition of specialized legal knowledge as a body of specialised information possessed by experts in accordance with their academic specialty within the system of legal sciences and used for the objective resolution of practical problems. On the basis of the proposed approach, scientific legal expertise is defined as an examination of practical problems requiring the use of specialized legal knowledge, with an expert opinion issued as a result for the purpose of enabling a competent person to make an appropriate decision. The theses conclude that further legal regulation of scientific legal expertise in Ukraine remains relevant.

У тезах обґрунтовується доцільність використання універсального терміна «спеціалізовані правові знання» для позначення знань експертів у різних галузях юридичних наук. Виходячи з класифікації юридичних наук та особливостей підготовки наукових кадрів, доведено, що експерт є обізнаним фахівцем у відповідній галузі юридичної науки та науковій спеціальності, а його знання мають спеціалізований характер. Запропоновано авторське визначення поняття «спеціалізовані правові знання» як сукупності відомостей спеціалізованого виду, якими володіють експерти відповідно до наукової спеціальності в системі юридичних наук та які використовуються для об'єктивного вирішення практичних проблем. На підставі запропонованого підходу сформульовано визначення науково-правової експертизи як дослідження практичних проблем, що потребують використання спеціалізованих правових знань, із наданням за результатами експертного висновку для прийняття компетентною особою відповідного рішення. Зроблено висновок про актуальність подальшого правового регулювання науково-правової експертизи в Україні.
