Чи є за необхідним укладення правочину з майном дітей під контролем органу опіки та піклування?

Abstract

У тезах розглядається проблема здійснення правочинів щодо майна дітей за участю та під контролем органів опіки та піклування. Проаналізовано положення цивільного та сімейного законодавства України щодо порядку вчинення правочинів малолітніми і неповнолітніми особами, а також повноваження батьків, усиновлювачів, опікунів і піклувальників при розпорядженні майном дітей. Звертається увага на історичний розвиток правового регулювання відповідних відносин, починаючи з римського права та законодавства Російської імперії до сучасного українського законодавства. Особливу увагу приділено новелам Цивільного та Сімейного кодексів України щодо необхідності отримання дозволу органів опіки та піклування на вчинення окремих правочинів. На підставі аналізу практики діяльності органів опіки та піклування обґрунтовується доцільність державного контролю за розпорядженням майном дітей як механізму забезпечення та захисту їх майнових прав і законних інтересів.

The conference paper examines the issue of legal transactions involving children's property carried out with the participation and under the supervision of guardianship and custodianship authorities. It analyzes the provisions of the civil and family legislation of Ukraine governing the procedure for legal transactions performed by minor children and juveniles, as well as the powers of parents, adoptive parents, guardians, and custodians in administering children's property. Attention is paid to the historical development of the legal regulation of these relations, from Roman law and the legislation of the Russian Empire to the contemporary legislation of independent Ukraine. The paper further examines the legislative innovations introduced by the Civil Code and the Family Code of Ukraine concerning the requirement to obtain permission from guardianship and custodianship authorities before concluding certain legal transactions involving children's property. Based on an analysis of the practice of guardianship and custodianship authorities, the author substantiates the necessity of state supervision over the administration and disposal of children's property as an effective mechanism for ensuring and protecting their property rights and legitimate interests.
