Управление имуществом ребенка по гражданскому законодательству Украины

Abstract

У статті досліджуються теоретичні та практичні проблеми управління майном дитини за цивільним законодавством України, розкривається правова природа управління майном дитини, визначаються його сутність, мета, принципи та місце в системі механізмів забезпечення майнових прав дитини. Запропоновано авторське визначення поняття управління майном дитини як юридично закріпленої діяльності суб'єктів управління, спрямованої на ефективну реалізацію права дитини на майно. Досліджено правовий статус законних представників дитини як суб'єктів управління її майном. Значну увагу зосереджено на аналізу законодавчих змін щодо порядку надання дозволів на вчинення правочинів з майном дитини, а також ролі органу опіки та піклування у забезпеченні збереження житлових і майнових прав дитини. Водночас узагальнено результати практичної та експериментальної роботи за цим спрямуванням, що набули ефективного застосування в діяльності органу опіки та піклування Київської районної у місті Донецьку ради. Завдяки історико-правового аналізу розвитку інституту управління майном дитини від римського приватного права до законодавства Російської імперії, СРСР та незалежної України, зроблено висновок щодо фрагментарного характеру чинної моделі управління майном дитини, яка не здатна забезпечити комплексне врегулювання відповідних правовідносин, як це спостерігається в суспільствах з приватною формою власності. Запропоновано ефективну цілісну правову модель управління майном дитини та впровадження її прийняттям спеціального Закону України «Про управління майном дитини», який має визначати права й обов'язки суб'єктів управління, порядок здійснення управління майном, повноваження органів опіки та піклування, механізми контролю та гарантії захисту майнових прав дитини.

The article examines the theoretical and practical issues of the management of a child's property under the civil legislation of Ukraine. It reveals the legal nature of the management of a child's property, defines its essence, purpose, principles, and place within the system of mechanisms for ensuring a child's property rights. The author proposes an original definition of the management of a child's property as a legally regulated activity of the subjects of property management aimed at the effective exercise of a child's property rights. The study examines the legal status of a child's legal representatives as subjects responsible for managing the child's property. Particular attention is paid to legislative amendments governing the procedure for granting permission to enter into legal transactions involving a child's property, as well as to the role of guardianship and custodianship authorities in safeguarding the child's housing and property rights. The article also summarizes the results of practical and experimental work in this field, which were successfully implemented in the activities of the guardianship and custodianship authority of the Kyiv District Council in the city of Donetsk. Through a historical and legal analysis of the development of the institution of the management of a child's property—from Roman private law through the legislation of the Russian Empire, the USSR, and independent Ukraine—the author concludes that the current model of managing a child's property is fragmented and incapable of providing comprehensive regulation of the relevant legal relations, unlike the approaches observed in legal systems based on private ownership. The article proposes a comprehensive legal model for the management of a child's property and substantiates the need for its implementation through the adoption of a special Law of Ukraine "On the Management of a Child's Property," which should define the rights and obligations of the subjects of property management, the procedure for managing a child's property, the powers of guardianship and custodianship authorities, control mechanisms, and guarantees for the protection of a child's property rights.
