Роль договірного регулювання механізму доказування істотної зміни обставин

Abstract

У статті ідентифіковано проблеми, що виникають у процесі доказування істотної зміни обставин у контексті правозастосування та встановлено, що наразі, пріоритетним є формування чітко окресленого, ефективного інституту істотної зміни обставин, адаптацію правових підходів його регулювання відповідно до нових викликів. Вказана проблематика прослідковується при практичній реалізації норм статті 652 Цивільного кодексу України, зокрема в переважній більшості судових рішень досить критично оцінюються докази наявності істотної зміни обставин. Тому збалансувати майнові інтереси сторін при виникненні істотної зміни обставин стає досить обтяжливим, а норми вказаної вище статті в існуючій на сьогодні редакції недостатньо чітко визначають механізми її доказування, що призводить до виникнення юридичних суперечок та правових невизначеностей. Саме формування механізму доказування наявності істотної зміни обставин сприятиме прозорості договірних відносин, покращенню договірної дисципліни, зниженню правових ризиків, справедливому врегулюванню спорів, полегшенню судового розгляду. А для забезпечення дотримання принципу свободи договірних відносин важливо законодавчо закріпити обов’язок з визначення такого механізму самими сторонами в договорі.

The article identifies problems arising in the process of proving a material change of circumstances in the context of law enforcement and establishes that, at present, priority should be given to the formation of a clearly defined and effective institution of material change of circumstances, as well as the adaptation of legal approaches to its regulation in accordance with new challenges. The identified issues are observed in the practical application of Article 652 of the Civil Code of Ukraine, in particular, in the vast majority of court decisions, the evidence of the existence of a material change of circumstances is assessed in a rather critical manner. Therefore, balancing the property interests of the parties in the event of a material change of circumstances becomes rather burdensome, while the provisions of the above-mentioned Article in its current wording do not sufficiently clearly define the mechanisms of its proof, which leads to legal disputes and legal uncertainty. The formation of a mechanism for proving the existence of a material change of circumstances would contribute to the transparency of contractual relations, the improvement of contractual discipline, the reduction of legal risks, the fair settlement of disputes, and the facilitation of judicial proceedings. At the same time, in order to ensure compliance with the principle of freedom of contract, it is important to enshrine at the legislative level the obligation for the parties themselves to define such a mechanism in the contract.
