Захист прав дитини на житло в гуртожитках державної та комунальної власності

Abstract

У тезах висвітлюються проблеми забезпечення та захисту житлових прав дітей, які проживають у гуртожитках державної та комунальної власності. На підставі аналізу житлового законодавства України, судової практики та діяльності органів опіки та піклування встановлено відсутність належних правових гарантій збереження житлових прав дітей у разі їх тимчасової відсутності у гуртожитку. Обґрунтовано необхідність удосконалення житлового законодавства шляхом запровадження спеціального механізму збереження житлової площі за дитиною на період такої відсутності. З метою посилення гарантій захисту житлових прав дітей запропоновано доповнити Житловий кодекс України нормою щодо збереження житлової площі в гуртожитку за тимчасово відсутньою дитиною. Запропонований механізм передбачає збереження за дитиною права користування житловим приміщенням, можливість передачі такого приміщення в оренду з накопиченням коштів на її особистому рахунку, а також забезпечення реалізації права на приватизацію житла після досягнення повноліття. Зроблено висновок, що впровадження запропонованих змін сприятиме посиленню гарантій захисту житлових прав дітей та запобігатиме їх втраті внаслідок недосконалості чинного правового регулювання.

The conference paper addresses the issues of ensuring and protecting the housing rights of children residing in state- and municipally-owned dormitories. Based on an analysis of the housing legislation of Ukraine, judicial practice, and the activities of guardianship and custodianship authorities, the author identifies the absence of adequate legal guarantees for preserving children's housing rights during their temporary absence from a dormitory. The paper substantiates the need to improve the housing legislation of Ukraine by introducing a special mechanism for preserving living space for a child throughout the period of such temporary absence. To strengthen the guarantees for the protection of children's housing rights, the author proposes supplementing the Housing Code of Ukraine with a provision ensuring the preservation of living space in a dormitory for a temporarily absent child. The proposed mechanism provides for the preservation of the child's right to use the residential premises, the possibility of leasing such premises with rental income accumulated in the child's personal account, and the safeguarding of the child's right to privatize the dwelling upon reaching the age of majority. The paper concludes that the implementation of the proposed legislative amendments would strengthen the guarantees for the protection of children's housing rights and prevent their loss as a result of deficiencies in the existing legal regulation.
